01/26/05 - Jo Ann Davis, Member of Congress, calls for President Bush to issue a "clear directive to FEMA" and a prompt investigation of the policy sales, use of premiums, and claims handling practices carried out by the NFIP, its contractors and insurance partners. She also calls for Congressional probe.

Rep. Davis, R-VA, unwilling to stand still while her constituents' lead a "tortured existence" living for 16 months in FEMA campers designed for summer use, called upon President Bush to direct FEMA to follow the Congressional intent for the NFIP - restore victims to their pre-flood conditions.

"I was concerned to learn an investigation by retired fraud detection and pattern recognition expert, Mr. Steven Kanstoroom, found insurance companies refusing to fairly pay flood claims for fear of setting a precedent on their non-flood claims" Congresswoman Davis said.

In November Rep. Davis wrote to Attorney General Ashcroft saying she was even more troubled by the potential conflict of interest the advocates showed her regarding insurance industry lawyer Gerald J. Nielsen. She was also troubled by a letter received from a former Presidential appointee and Texas Insurance Commissioner's conclusion "fraud may have occurred on a large scale" within the National Flood Insurance Program.

After waiting sixty days for a response from the DOJ, Davis wrote to President Bush regarding her continuing concerns that the same lawyer who represents virtually every WYO insurance carrier, trains the NFIP general adjusters and DHS IG special agents.

Davis also called upon Congressman Oxley, the Chairman of the House Financial Services Committee, to hold hearings to evaluate ongoing issues with the NFIP. Included would be an evaluation of NFIP's policy sales, use of premiums and claims handling practices.
